Appeal Result: Permission Granted
Description: Retention of four cylindrical storage tanks and associated support structure (Part Retrospective); and installation of steel cladding onto support structure to form a screen.
Refusal Stated: "The storage tanks and supporting structure to be retained and steel cladding to be installed, by reason of their design, location and visual prominence, would materially detract from the appearance of the building and character of the street scene. As such, the proposal is considered contrary to Section 12 of the National Planning Policy Framework (2019), as well as, policies 7.4 and 7.6 of the London Plan (2016); and 7B and 7.4 of the Ealing Development Management DPD (2013).
Insufficient detail and information on the proposed clean-up of any spills, handling, and storage of the substances to be stored in the storage tanks to be retained to ensure that any hazardous substances and materials are managed in a way that limits risk to London’s people, environment and infrastructure. As such, the proposal is considered contrary to Section 15 of the National Planning Policy Framework (2019), as well as, polices 5.22 of the London Plan (2016); and 7A of the Ealing Development Management DPD (2013)."
Background: The initial refusal issued by Ealing Council against this retrospective development threatened to be a serious concern for our client. The pre-existing storage tanks were a vital component necessary for their factory to operate. Without permission there was a real chance the structure would have to be removed, which would prove disastrous for their operation. LSE took charge of the case and argued that the development was inline with overall policy when considering the industrial setting that the appeal site is located within. Concerns regarding the lack of information supplied in the initial application were dealt with by way of a condition. This enabled the appellant to supply further information to the LPA post appeal, which avoided the case being derailed. The Planning Inspectorate thus granted permission which was a great result for our client and their business.
